SECTION 1: FEDERAL LAW & ATF REGULATIONS (THE ATF 2022 FINAL RULE)

1.1 The Current Regulatory Landscape
As of August 24, 2022, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) enacted the Final Rule 2021R-05F, “Definition of Frame or Receiver and Identification of Firearms.” This rule fundamentally changed the legal status of many products we and others sell.

1.2 Definition of a “Firearm”
Under this rule:

  • “frame or receiver” is defined as “a part of a firearm that provides housing or a structure for the component (e.g., sear or bolt) and is designed to hold or integrate any fire control component.”
  • “Partially complete, disassembled, or non-functional frames or receivers” that are “readily convertible” are now classified as firearms.
  • “Combinations of parts” sold together that are designed to or may readily be completed, assembled, restored, or otherwise converted to function as a frame or receiver are also classified as firearms.

1.3 What This Means for Your Purchase

  • Products labeled as “80% Lowers,” “80% Frames,” “Unfinished Receivers,” or “Gun Build Kits” that contain a frame/receiver blank may now be legally classified as firearms at the point of sale.
  • Our business model has been structured in good faith to operate. However, the ultimate legal determination of the status of any item rests with the ATF and federal courts.
  • It is your responsibility, the purchaser, to understand that purchasing these items may constitute the purchase of a firearm under federal law, depending on interpretation and enforcement.

By proceeding with any purchase, you expressly represent and warrant that:

2.1 Eligibility:

  • You are at least 21 years of age for frames/receivers and handgun components, or 18 years of age for rifle components where applicable.
  • You are not a prohibited person under federal law (18 U.S.C. § 922(g) or (n)). This includes persons convicted of a felony, under indictment, unlawful user of controlled substances, adjudicated mentally defective, subject to certain restraining orders, etc.
  • You are a U.S. Citizen or legal permanent resident with a valid alien number.

2.2 Intent & Final Authority:

  • You understand that frames, receivers, and kits purchased may require further manufacturing steps to become a functional firearm.
  • You affirm that you are manufacturing a firearm for personal use only, not for resale or distribution, unless you hold the appropriate Federal Firearms License (FFL).
  • You understand that state and local laws are supreme and may further restrict or prohibit your actions, regardless of federal interpretations.
  • You acknowledge that [Your Company Name] is not a law firm and does not provide legal advice. You are responsible for consulting with your own legal counsel regarding the legality of your actions in your jurisdiction.

SECTION 3: STATE & LOCAL LAW COMPLIANCE – THE PURCHASER’S DUTY

Federal law is the minimum standard. Many states and municipalities have enacted laws that are more restrictive.

3.1 Prohibition States/Jurisdictions:
It is expressly prohibited to ship items deemed to be firearm components or unfinished frames/receivers to addresses in the following states and jurisdictions, regardless of any claims about their legality. This list is not exhaustive and may change:

  • California
  • New York
  • New Jersey
  • Washington
  • Illinois (including Chicago)
  • Connecticut
  • Maryland
  • Massachusetts
  • Hawaii
  • Rhode Island
  • Washington D.C.
  • Any other city, county, or state with bans on “ghost guns,” “unserialized firearms,” or “unfinished frames/receivers.”

3.2 Your Affirmation:
You affirm that you have independently researched and confirmed that the purchase, possession, and manufacturing of the items in your order are legal in your specific city, county, and state. We rely on your representation.


SECTION 4: SHIPPING, RECEIVING, & MANUFACTURING

4.1 Shipping Policy:

  • All items are shipped discreetly via common carrier to the address provided at checkout.
  • We do not ship to P.O. Boxes, APO/FPO addresses, or international destinations.
  • We reserve the right to cancel any order and refund payment if we cannot verify the shipping address or suspect a violation of our terms.

4.2 Receiving Your Order:

  • You affirm you will be the direct recipient of the order. Straw purchases are a federal felony.
  • You affirm the shipping address is a secure location where you can receive packages.

4.3 Manufacturing a Firearm:

  • If you complete a frame/receiver into a functional firearm, federal law requires you to engrave or mark it with a serial number and your identifying information (city, state, name or trust name) if it is ever sold or otherwise leaves your possession. (27 CFR § 478.92).
  • You are responsible for ensuring the final firearm complies with all laws, including the National Firearms Act (NFA) regarding barrel length, overall length, etc.

SECTION 5: DISCLAIMERS OF LIABILITY & INDEMNIFICATION

5.1 “As-Is” Sale:
All products are sold “AS-IS” and “WITH ALL FAULTS.” We make no warranties, express or implied, regarding the legality, fitness for a particular purpose, or merchantability of any item for your specific situation.

5.2 No Legal Advice:

5.3 Indemnification:
You agree to indemnify, defend, and hold harmless Polymer80 Firearms, its owners, agents, and affiliates from and against any and all claims, damages, losses, costs, fines, and expenses (including attorney fees) arising from your purchase, possession, or use of any product, or your violation of any law or this agreement.

5.4 Limitation of Liability:
Our total liability to you for any claim shall not exceed the purchase price of the product at issue.
